General terms and conditions of business

Purchased products are not subject to warranty or replacement in the event of customer operating errors.

1. Scope

1.1 These General Terms and Conditions (GTC) apply to all orders and contracts concluded between Melisa Gold GmbH and its customers.

1.2 Deviating terms and conditions of the customer are not recognized unless Melisa Gold GmbH expressly agrees to their validity in writing.

2. Retention of Title

The delivered goods remain the property of Melisa Gold GmbH until full payment has been received.

3. Right of Withdrawal

The customer has the right to withdraw from the contract within 14 days without giving reasons. You can find detailed information on the right of withdrawal and the sample withdrawal form on our website.

4. Warranty and Guarantees

4.1 The statutory warranty provisions apply.

4.2 Guarantees for the goods only exist if they have been expressly stated by us in writing.

5. Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find at http://ec.europa.eu/consumers/odr/. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

6. Claims for Defects/Liability for Damages

6.1 In the event of defects in the delivered goods, the statutory provisions apply.

7. Liability

Melisa Gold GmbH is only liable for damages caused by intent or gross negligence on the part of Melisa Gold GmbH or its employees.

8. Transport Damage

Melisa Gold GmbH assumes no liability for transport damage. The customer is obliged to report transport damage immediately to the transport company and to inform Melisa Gold GmbH thereof. Please note that we also assume no responsibility in the event of loss or damage during shipping.

9. Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless compelling legal provisions prevent this.

10. Return Policy

10.1 The customer is entitled to a right of return in accordance with the statutory provisions.

10.2 Unworn and undamaged items can be exchanged or returned within 14 days. The delivery date is decisive here.

Important: Custom-made products, personalized items (e.g. with names, dates or initials) and earrings are excluded from exchange or return.

10.3 Cash refunds are excluded for the entire product range. Only an exchange for goods of equal value or the issuance of a voucher is offered.

11. Contract Language and Storage of Contract Text

The contract language is German. The contract text is not stored by us and can no longer be retrieved after the order process has been completed.

12. Erroneous Information

Melisa Gold GmbH reserves the right to withdraw from the contract or make corresponding adjustments in the event of erroneous information or typographical errors.

13. Dispute Resolution/Customer Service

For questions, complaints or disputes, our customer service representatives are available at the contact details provided above.

14. Delivery Conditions

14.1 The goods will be shipped to the customer within 48 hours of payment receipt, unless otherwise agreed.

14.2 A third-party or transport company will be commissioned for the delivery of the goods. The GTC of the third-party or transport company apply. Melisa Gold GmbH assumes no obligations from the GTC of the third-party or transport company, but strives for smooth and timely delivery.

15. Prices, Shipping and Payment

15.1 The prices stated in the online shop include the statutory value-added tax (VAT).

15.2 In addition to the stated prices, flat-rate shipping costs may apply depending on the value of the goods and the chosen shipping method. The exact shipping costs will be communicated to the customer during the order process.

15.3 Payment is made using the payment methods offered by Melisa Gold GmbH, which are available to the customer during the order process.

16. Variable Prices due to Stock Exchange Gold Prices

16.1 Due to the variable nature of stock exchange gold prices, the prices for our jewelry can change daily. We therefore reserve the right to adjust prices accordingly to reflect current stock exchange gold prices.

16.2 Please note that due to this price volatility, there may be differences in prices from day to day. The current prices will be displayed to you during the order process.
